In particular, bookit.kg does not guarantee the accuracy and assumes no responsibility for any errors or inaccuracies relating to the information and descriptions of air and other travel products displayed on the Site (including, without limitation, pricing, photographs, general descriptions, etc.), as most of this information is provided by the respective service providers. Additionally, Bookit.kg reserves the right to correct any pricing errors on our Site and/or on pending reservations made under an incorrect price. In such cases, we will offer you the opportunity to keep your reservation at the correct price, if it is available, or we will cancel your reservation without penalty.
Bookit.kg and its suppliers make no representations about the suitability / fitness of the information, software, products, and services contained on this Site, and the presence or offering of any products or services on the site does not constitute endorsement or recommendation of such products or services by Bookit.kg. Such information, software, products, and services are provided "as is" without any warranties. Bookit.kg and its suppliers do not guarantee that this site, its services, or any electronic emails sent on behalf of Bookit.kg and/or its suppliers are free of viruses or other harmful components. Therefore, Bookit.kg and its suppliers disclaim any warranties regarding such information, software, products and services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Carriers and other providers of tourist or other services on this Site are independent contractors, not agents or employees of Bookit.kg. Bookit.kg is not responsible for the actions, errors, omissions, statements, warranties, breaches or negligence of such providers or for any damage, death, loss of property, or any other harm caused by them. Under no circumstances can Bookit.kg and/or its suppliers be liable for any direct, indirect, punitive, incidental, special or consequential damages arising from or in any way connected with access to, viewing or use of this site (including, if necessary, your trust in the opinions appearing on this site; computer viruses, information, software, links to other sites, products and services taken from the site; or appearing on the site during its visit, viewing or usage) or due to negligence, consent, tort, strict liability or anything else, even if Bookit.kg and/or its suppliers were informed of the possibility of such damage.
If, despite all of the foregoing, Bookit.kg or its suppliers have been found liable for any loss or damage which arises out of or is in any way connected with any of the above described functions, then the liabilities of Bookit.kg and/or its suppliers will in no event exceed, in the aggregate, the greater of (a) the service fees you paid to Bookit.kg in connection with such transaction(s) on this website, or (b) one hundred dollars ($100.00) or the equivalent in local currency.
The contractual limitation of liability reflects the risk distribution between the parties. The limitations set forth in this section will take place and apply even if the limited measures provided for in these regulations are deemed to not fulfill their true purpose. The limitation of liability established in these rules is for the benefit of Bookit.kg Companies, Bookit.kg branches, and/or other relevant suppliers.
You agree to defend and indemnify Bookit.kg and/or its suppliers and their officers, directors, employees, and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including, but not limited to, reasonable legal fees, caused by third parties as a result of:
Any software available for download from this Site ("Software") is the property of Bookit.kg and/or its suppliers and is protected by copyright. Use of such Software is governed by the terms of the user license agreement, if any, which accompanies or is included with the Software ("License Agreement"). You may not install or use any Software that comes with or contains a License Agreement unless you agree to the terms and conditions of the License Agreement. Any Software available for download from this Site not accompanied by a License Agreement, we grant to you, the user, a limited, personal, non-transferable license to use the Software for the purpose of viewing and using this Site in accordance with these terms and provisions, and for no other purposes.
Please note that all Software, including, without limitation, all HTML codes and Active X controls contained on the Site, is owned by Bookit.kg and/or its suppliers, and is protected by copyright laws and international treaty provisions. Any reproduction or redistribution of the Software is expressly prohibited, and may result in severe civil penalties and criminal prosecution. Violators will be subject to the strictest possible penalties.
Without limiting the foregoing, copying or reproducing the software to other servers or locations for further reproduction or redistribution is expressly prohibited. The software is warrantied only if the rules and conditions of the license agreement are adhered to.
The site is managed by the organization of the Kyrgyz Republic, and this Agreement is governed by the laws of the Kyrgyz Republic. You hereby agree to the exclusive jurisdiction and venue for any dispute arising out of or relating to this Site in Bishkek. The use of the site is unauthorized in any jurisdiction that does not enforce all provisions of these terms and conditions, including, without limitation, this paragraph.
If any part of the Agreement is deemed invalid, illegal or unenforceable, the legal force, legality and enforceability of the other provisions, under no circumstances, can be affected or lost.
The Agreement (and any rules and conditions stated in it) constitutes the entire agreement between You and Bookit.kg, regarding this Site and overrides all prior or present communications and proposals, in electronic, written, or oral form, between the customer and Bookit.kg regarding this Site. A printed form of this Agreement and any warning/notice issued in electronic form should be submitted in court or administrative procedures based on or relating to this Agreement, in accordance with the same measures and on the same terms as other business documentation and records originally presented in printed form.
